WOTUS Repeal Update

The U.S. Environmental Protection Agency (EPA) and Army Corps of Engineers have formally proposed the withdrawal of the Obama Administration’s highly controversial water rule. The formal notice appeared in the Federal Register on Thursday, July 27th.  It provides for a 30 day public comment period on the proposal.  

The Obama water rule has been put on hold by the 6th Circuit Court of Appeals since shortly after it was finalized in 2015. This proposal would remove the Obama rule from the books and allow the current EPA to work on its own rule to define the jurisdictional reach of the Clean Water Act.  That proposal is expected to be released before the end of the year.  

IMA-NA has been working extensively within an industry coalition and will be putting together comments both within that coalition and submitting our own comments which will support the coalition comments.
