On May 12, 2016, OSHA published its final rule requiring many employers to electronically file their injury and illness reports, in a way that will be publicly disclosed and searchable. Whether you view this as a "nudge" to employers to eliminate safety hazards (as OSHA claims) or have concerns about the consequences of this "public shaming" campaign, there are new legal requirements that will take effect in 2017 for both large and small employers. In addition, the rule clarifies whistleblower protections for workers who report injuries, and imposes new requirements on employers procedurally and with respect to incentive and disciplinary programs affecting injured workers.
