Status of MSHA POV and Flagrant Litigation
Dana Svendsen, an attorney at Jackson Kelly PLLC, will be addressing the Safety and Health Committee meeting at the IMA-NA 2015 Annual Meeting on Thursday, September 17. Two of the most severe sanctions MSHA can levy are the flagrant designation for individual violations and the Pattern of Violations (POV) designation. Yet, years after the flagrant provision was enacted and MSHA began its renewed focus on POV, application of both sanctions remains mired in uncertainty. Ms. Svendsen’s presentation will discuss the current state of the flagrant designation and POV.
